Notice of Privacy Practices (HIPAA)

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

• Get a copy of your prescription and health records. You can ask to see or get a copy of your prescription records and other health information we have about you. We will provide a copy or a summary, usually within 30 days of your request. We may charge a reasonable, cost-based fee.
• Ask us to correct your record. You can ask us to correct health information about you that you think is incorrect or incomplete. We may say “no” to your request, but we will tell you why in writing within 60 days.
• Request confidential communications. You can ask us to contact you in a specific way (for example, home or mobile phone) or to send mail to a different address. We will say “yes” to all reasonable requests.
• Ask us to limit what we use or share. You can ask us not to use or share certain health information for treatment, payment, or our operations. We are not required to agree, and we may say “no” if it would affect your care. If you pay for a service or item out of pocket in full, you can ask us not to share that information with your health plan for payment or operations, and we will say “yes” unless a law requires us to share it.
• Get a list of those with whom we have shared information. You can ask for a list (accounting) of the times we have shared your health information for six years prior to the date you ask, who we shared it with, and why. We will provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another within 12 months.
• Get a copy of this privacy notice. You can ask for a paper copy of this notice at any time, even if you have agreed to receive it electronically.
• Choose someone to act for you. If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will make sure the person has this authority and can act for you before we take any action.
• File a complaint if you feel your rights are violated. You can complain if you feel we have violated your rights by contacting us using the information below. You can also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not retaliate against you for filing a complaint.

Your Choices

For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations below, talk to us. Tell us what you want us to do, and we will follow your instructions.

You have both the right and choice to tell us to:

• Share information with your family, close friends, or others involved in payment for your care.
• Share information in a disaster relief situation.

If you are not able to tell us your preference, for example if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.

We never share your information for marketing purposes or sell your information without your written permission.

Our Uses and Disclosures

We typically use or share your health information in the following ways.

Special protections under New York law: Some of your information, such as HIV-related, genetic, mental health, and substance-use disorder records, has extra protection under New York State law, and we follow those stricter rules.

• Fill your prescriptions and treat you. We use your health information to dispense prescriptions and to coordinate your care. For example, we may contact your prescriber about a prescription, counsel you on your medications, or check for drug interactions.
• Run our pharmacy. We use and share your health information to operate our pharmacy, improve your care, and contact you when necessary, for example, to remind you about refills or to notify you that a prescription is ready.
• Bill for your medications. We use and share your health information to bill and get payment from health plans, pharmacy benefit managers (PBMs), or other entities. For example, we give information about you to your prescription drug plan so it will pay for your medications.
• Help with public health and safety issues. We can share health information about you for certain situations such as preventing disease, reporting adverse reactions to medications, reporting suspected abuse or neglect, and preventing or reducing a serious threat to anyone’s health or safety.
• Comply with the law, and respond to lawsuits and legal actions. We will share information about you if state or federal laws require it, including with the Department of Health and Human Services if it wants to see that we are complying with federal privacy law. We can share health information about you in response to a court or administrative order, or in response to a subpoena.
• Work with a medical examiner or funeral director, for organ donation, workers’ compensation, law enforcement, and other government requests. We can use or share health information about you for workers’ compensation claims, for law enforcement purposes or with a law enforcement official, with health oversight agencies for activities authorized by law, and for special government functions such as military, national security, and presidential protective services.

Our Responsibilities

• We are required by law to maintain the privacy and security of your protected health information.
• We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
• We must follow the duties and privacy practices described in this notice and give you a copy of it.
• We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time by letting us know in writing.

Changes to the Terms of This Notice

We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our pharmacy, and on our website at bandbrx.com/legal.

Notice of Nondiscrimination

Information We Collect

Information Sharing

We do not sell your personal or health information. We may share information only as described in this policy and our HIPAA Notice, specifically with:

• Your healthcare providers (with your consent or as permitted by HIPAA).
• Your insurance company for billing.
• Service providers (form processing, delivery, analytics) bound by confidentiality agreements.
• Government agencies (when legally required).

Third-Party Services We Use

To run this website, we rely on the following service providers. Each is bound by their own privacy policy and contractual terms with us:

• Netlify, Inc., website hosting and content delivery. netlify.com/privacy
• Formspree, Inc., secure form submission processing. Form submissions are transmitted via HTTPS, processed by Formspree, then forwarded to our pharmacy email at bandbrx@gmail.com. formspree.io/legal/privacy-policy
• Google Translate, optional, on-demand translation of page content into Spanish, Russian, Hindi, or Bengali. No personal information is sent to Google for translation; only the displayed page text. policies.google.com/privacy
• Cloudflare (cdnjs), delivers the PDF-generation library (jsPDF) used to create your downloadable forms. PDF generation happens entirely in your browser; your form data does not leave your device during PDF creation.
• U.S. National Library of Medicine (RxNav) and U.S. FDA (openFDA), public health databases queried only when you search for a medication; queries contain only the medication name you typed.

Form Submissions & Email Notification

When you submit any form on this site (vaccine registration, prescription transfer, delivery request, contact form, newsletter signup):

• Your submission is sent over HTTPS to Formspree, which forwards it to our pharmacy email at bandbrx@gmail.com.
• We retain submissions in our email and pharmacy management system for as long as needed to provide service and meet legal/regulatory requirements (typically 7 years for medical records, per New York pharmacy law).
• You may request deletion of your submission at any time by emailing bandbrx@gmail.com; we will honor such requests subject to legal retention requirements.

Data Security

We use industry-standard encryption (HTTPS/TLS 1.2+) for all data transmission. Our website enforces HTTP Strict Transport Security (HSTS), Content Security Policy (CSP), X-Frame-Options, and other defensive HTTP headers. Subresource Integrity (SRI) is used to verify that external scripts have not been tampered with. Health information is protected under HIPAA Security Rule administrative, physical, and technical safeguards. While no method of electronic transmission is 100% secure, we work hard to protect your information.

Cookies

This site uses only essential cookies needed for core functionality (language preference, theme preference, session). We do not use third-party advertising or tracking cookies. If you use the Google Translate feature, Google may set its own cookies on your device per its privacy policy.

Your Data Rights (GDPR / CCPA equivalent)

Regardless of where you live, you may at any time:

• Request correction of inaccurate information.
• Request deletion of your information (subject to legal record-retention rules for medical records).
